Legal Question in Personal Injury in Tennessee

Personal injury settlement with the insurance company; what is fair?

I was involved in an accident in Sept 03. I was a pedestrian in a parking lot at a rest stop. I was backed over by a driver who had no insurance. I filed a claim with my insurance company. They have attempted to settle with me for $1000.00. This does not seem fair, being I am just now (May 04) back to a point I would call normal. I encurred multiple abrasion from head to toe, problems with both shoulders from being rolled under the vehicle, bruising all over my chest, and an elbow that still is sensitive to pressure. I was certainly worried about my military career and how the accident would effect that. I have progressed far enough to be okay in my career. I have a variety of large scars from the road rash as reminders however. I still have a little stiffness in my shoulders, but it is tolerable. What is an appropriate amount to expect from my insurance company for compensation and if I do settle with them who is responsible to cover the doctors and hospital bills? Does that come out of the settlement or do they pay them seperately?

Sir...$1,000.00 is definitely not enough for what you have been through. Any settlement you receive will include the medical expenses you have or will have incurred....even if the expenses were paid by the government. The only way you can get around having to pay the medical expenses is if the medical providers waive payment otherwise they can sue you to recover the expenses which is very doubtful. I would like to talk with you. You may e-mail be at [email protected] or call me at 931 552 3475. I look forward to hearing from you. Bill Poland
