Legal Question in Personal Injury in Tennessee

rearend collision and personal injury

I was stopped at a stop sign and looking to see if it was safe to merge into traffic on another street. I had looked in my rear view mirror on my approach to the stop sign and there was no car visable.

After I had stopped, I looked to the left to check traffic when out of the blue I was struck quite hard in the rear. I had my foot on the brake but it shoved me over the crosswalk line towards the busy street so I had to turn my wheel to avoid being sent into the busy street. I was finally able to stop my vehicle. I got out and motioned for the other driver to join me. I pulled out my wallet to get my papers out to exchange information. I asked her to go to the near by store and call a policeman. she refused saying she couldnt she had a stroke and had copd. I am 72 yrs old and disabled so I had to ask a passing pedestrian to call for me. I believe I had been shoved ahead 25 to 50 feet. She was driving a pickup, I was driving a ford escort. She told the policeman I had started to pull away and stopped, which I had never left the stop sign area. The policeman sited her as

being inattentive and failing to yield right of way, I was not sited at all.I have a concusion and contusions. Do I have reason enough to go to court?

Re: rearend collision and personal injury

Based on the facts presented, you quite possibly do have a cause of action. An attorney would need to look at the police report and speak with you to fully evaluate. Let us know if we can help.
