Legal Question in Personal Injury in Tennessee

twisted auto accident question

Being in the military, I was sent on Temporary Duty for 6 months and left my Tahoe with a ''friend'' for storage. She was in an accident - hit a pole i think - and claims she didn't do it. She refuses to pay for any damages, which has been assessed by a collision repair center at $1200. i have no proof of the vehicle's condition before i left. the vehicle was underinsured the entire time i was gone, as it wasn't supposed to be driven. what's the best route to go with this? Small claims court? a large italian man with a bad accent and a baseball bat? any advice would be much appreciated.

Small claims court is your best bet. The dollar limit on judgments is $5000, so your $1200 suit will meet the jurisdictional limit. With regard to the fact that you have no �proof� of the vehicle�s condition, you do have evidence, i.e., your own sworn testimony.
