Legal Question in Traffic Law in Tennessee

Driving with Occupational License

My fiance moved to TN last Sept. ~4 mos ago my fiance tried to get a TN license (the delay due to a misplaced birth certificate) and he discovered his PA license had been suspended for 6+ mos, apparently for expired PA vehicle registration. It was a 90 day suspension. Since he did have valid registration at the time of ticketing, he contacted a lawyer in PA who said he could get the matter resolved in 2 weeks and not to turn in his license to begin serving his 90 days since if my fiance was pulled over, he would be protected under legal advisement. We paid the lawyer upfront. 3 mos later, nothing had been done. For another 2 months my fiance continually called the lawyer to ask him either to actively work on his case, or to drop it so he could begin serving his 90 day suspension and refund our money. 2 weeks ago, the lawyer finally refunded our money, minus a ''consultation fee'' but only after my fiance threatened to file a formal complaint with the local bar association. My fiance has obtained an occupational permit and TN ID and sent in his PA license yesterday. W/ Xmas approaching, my fiance wants to drive home to PA but we are concerned w/ the risks involved if he should be pulled over for driving with an occupational license?

Re: Driving with Occupational License

You asked about driving with a suspended license.

DON'T.

Sorry about the travails with your attorney. You probably should go ahead and file that complaint. Save another person from the same headache you had.

As to the license. An occupational license is just that. Any other use is illegal. He should check the bus schedules and use the time to listen to music or read. Maybe even see if can find a ride share locally or on the Internet.

Tell him not to drive. You don't want to visit him in jail for x-mas, do you?

Regards,

Roger
