Sale transactions involving real property in Tennessee must always be in writing. Further, the transaction should be memorialized in contract form for the probate record, if the property is part of an estate still in the probate process. If a fiduciary(e.g. executor) is handling the sale transaction as part of his/her probate duties, and on behalf of beneficiaries, then he/she should have the value established in a written appraisal.
