Legal Question in Wills and Trusts in Texas

Disinherited from my Grandmothers Esate

My Grandmother died in December of 1991. She left my Mother, her Brother and my Brother in her Will. I just recently found out that when she listed all living relatives that my name was completely excluded. I have been told that within one year of her death I was an equal heir to her Estate. The Estate is set up to distribute money over 10 years and will not be settled until December of 2001. I need to know if I have any legal rights to fight the estate based on being unfairly treated. My Brother and Mother have been telling me they would "make things right." I now have a 2 year old Son and I feel I owe it to him to try to contest this esate. Please contact me and let me know if I have a case. The part of the Estate that I should have received is now over $400,000. Please help me. Thank you.

Generally speaking, your grandmother had the right

to leave you out of her will. That said, you should

seek the advice of an attorney regarding what

options you might have. If you feel that your

grandmother was unduly influenced in leaving you

out of her will then you might have a case. There

certainly seems to be enough money to demand that

you look at your options with an attorney.
