Legal Question in Bankruptcy in Texas

Can I file bankruptcy a second time

I had a ch 7 discharged in 95 but am so far in debt due to over spending and a divorce that I am short each month about $1000. I will be retireing from the military in less than a year. Can I file ch 7 again now? I have 2 vehicles a 2001 and a 1996 truck. I wish to keep the 2001 will I be able to? Can payday loan companies be added to a chapter 7?

Re: Can I file bankruptcy a second time

I would need to know exactly what date you filed but I believe you could file under chapter 7. You are entitled to definitely file for chapter 13 and that could actually be another option for you. Payday loans are terrible in terms of the interest you are paying if you were to calculate it on an annual basis. I'm happy to say these loans can definitely be eliminated in bankruptcy under either chapter. Please call me to discuss your options in more detail. ph. (214) 979-7330 or (800) 303-0720
