Homowners Rights

A homeowners' association publishes the names of memebers who are behind in their dues in the local newsletter. Assuming the information is accurate, on what grounds can the deliquent members sue the association? What are their chances of success in a tort action?

One of the named delinquent parties could arguably sue for invasion of privacy. The odds of winning are slim to none.

I agree with Mr. Brady. I would emphasize that communicating to the members information about names of the deliquent members is not actionable. Therefore, I would say the chances are closer to - 0 -. If the person posing this question has doubts about the answer, he can always find a lawyer willing to take his money and give the question a hard-fought run for the money.

As long as what is published is entirely accurate, you don't have a case. Truth is an absolute defense to a defamation action.
