Legal Question in Business Law in Texas

Small business owner who has customers who won't pay for services rendered

I own a small crane company. We rendered service to a company in October 2002 and still haven't been paid. The owner of the company tells us he has not been paid by the general contractor and the general contractor tells us he has been paid. We have invoices for each day we worked for the company which are signed by the company's employee. We call everyday, but can't afford to spend any money to be paid money that is rightfully ours. We have been told to file a judgement. Is that what we should do and how much does it cost. I think it is too late to file a lien. Please help!

You will have to sue them for the money, then move to collect on the judgment. If your records are good and the debtor is solvent, it can probably be handled on a contingent fee basis where all you have are the costs of filoing and service, and possibly a deposition.

You are right that it's too late for an M&M lien.

We handle a lot of similar collections.
