Out of State Attorney

If I'm looking for an attorney to represent my construction business in a litigation, do I need to use an attorney from my state (TX), or can any attorney in the US assist me?

You need to make sure that the attorney you use is licensed in the state in which the case is to be prosecuted (or pending.) An attorney may be licensed in more than one state.

If the litigation is here in Texas, then you may want to employ a Texas Law Firm.

You are going to want to hire an attorney licensed in the state in which the lawsuit is pending.
