Legal Question in Civil Rights Law in Texas

fired for bring overweight

My 20 year old daughter, works in a restaurant known for waitresses wearing skimpy outfits. She was employed there for 15 months. she is 5'10, and weighs 150 #. She was given 2 weeks to lose weight. She put her notice in during this time and was prepared to work out her 2 week notice. After about a week and a half, Her GM, called her in, and told her he had not seen a weight loss, and told her she was not allowed to finish her shifts, and terminated her on the spot. She lost wages, and was burdened financially. She was a good employee, and helped the company with sales production. Does she have any legal recourse?

Probably not..it could be discrimination for sex..ie only women...but call EEOC to see if they would accept a claim..Litigation would be expensive and as a member of AJA,TTLA etc..I know of no one who would take the case
