Loaned money never recieved back

I loaned a girlfriend of mine $5000 for a car almost a year ago. We are no longer friends and she has not paid me back a cent. She did write me a check sometime ago but the money was not in her account. Basically, it is a bad check. I am thinking about suiing her. She says she does not have the money. If the car is in her name even though I loaned her the money, would I be able to take the car from her? And also, if she doesn't have the money how would the courts get it from her??

In general, if she doesn't have any money, then you're wasting your time suing her. If you think she will have the money, then you can get a judgment, and maybe the court will even agree to give you the car, but at the end of the day you are responsible for enforcement of the order, not the court.
