possible theft of email used against me in legal battle

I am in a divorce case involving child support that I have not paid on time. Her lawyer had a deposition with my mother where he presented emails from my Hotmail account, a web based email company sponsored by Microsoft. I did not give my password to him or anyone else and I did not give permission for him or anyone else to retrieve these emails. He is going to use these against me to show perjury, etc in a court date yet to be set. I want to know what are my rights and what can he do to obtain emails legally and what can I do about it if he did not. What are my rights and what are his? I have contacted Hotmail with no response. These emails were apparently in my deleted items folder after I read them. I'm not sure.

the law does not protect hotmail email.
