2005 scion manual transmission

My so purchased a 2005 scion with a 60 day 3000 mile warranty.

He also purchased extended warranty, oil change service constact and an insueancethatwill replace the vehicle at full vaule.

The car had 27000 plus miles. He drove it 59 days and less than 2,000 miles. The clutch went out completely worn out. The service department people says it has no warranty because the car was abused. My son is a responsible driver and has never abused his vehicle. What can i do to get the honda company to repair it under warranty.

Give them a choice; repair under the extended warranty. or you'll have it repaired and sue them for the cost of repair. You could also point out that a breach of warranty is actionable under the Texas Deceptive Trade Practices/Consumer Protection Act, and may result in triple damages plus attorney fees. Their choice within the next ten business days.
