Legal Question in Consumer Law in Texas

Poor installation of counter tops

The company we hired to install our granite countertops did such a poor job that we are being told now we cannot install trim on it and our cabinets will probably not open when the weather changes because they didn't level the plywood on the bottom.

Cosmetically it is uneven an unattractive, but the main problem is that it is now unusable.

We are out $1000+ for the materials, and $750+ for labor.

Can we take them to small claims court?

Re: Poor installation of counter tops

Small Claims and Justice courts have a $5000.00 maximum in damages claims. You are under that limitation. However, you must be careful to sue the correct party. You must check out if the company is incorporated. If it is, that's who you sue. Don't be surprised if you find yourself up against an attorney representating the corporation.
