Legal Question in Consumer Law in Texas

A Weight Loss Center Contract

I signed a contract with a weight loss center on 23 March, I went in for two counseling sessions when I found out the total cost of the program was around $1300.00 for a weightloss of 25lbs. I called to cancel the program on the 29th of March, within 7 days. They want a letter from a doctor to say I shouldn't be doing this program in order to cancel. Don't I have a legal right to cancel a contract within a certain time frame. The only thing in the signed papers I have says $149.00 set up fee is non refundable. Do I have any legal rights? I hate to bother my doctor with this, we have a great relationship and his practice is extremely busy, I am post-cancer patient and if I bother him with this he will feel obligated to do the same for anyone that falls into this type of situation. I acknowledge that I was foolish in signing this, but I will also acknowledge I had no idea it would cost so much and it was mandatory to buy certain foods from them to ensure the success. I look forward to your advise.

Re: A Weight Loss Center Contract

There are two types of contract covered by FTC Reg Z that allows cancellation within 72 hours. The first is the sale of timeshares without seeing the property. The second is a home-solicitation sale with the salesperson present at your home. Both have their Reg Z notice about cancellation in bold print in the contract.

Don't worry about bothering your oncologist. He or she is perfectly capable of saying "NO" to you or others similarly situated. Since it's an economic issue rather than a health issue, you might get a "NO" in response.
