Legal Question in Credit and Debt Law in Texas

Cease & desist letter

Hello,

My wife currently has one govt funded student loan.At the time she was still enrolled & was in the prcess of deferring this loan. Mistakes were made on the paper work they got sent back & forth.Time ran out they sent it to a collection agency. Now the collection agency says its in default & wants the entire amount owed. We had also recieved a letter stating that they are going to start wage garnisment from my wifes employment. The original department will not talk to us they keep referring us back to the collection agency. I heard about a Cease & Desist letter that could remove it from collections & place it back with the original lender. Can I use this? How does it work? How can I obtain one.Thankyou for you time.

Re: Cease & desist letter

I would like to see the letter which said they were going to garnish your wife's wages. Wage garnishment is not permitted in TX and such a threat would be in violation of TX and Federal law. I have never used a cease and desist letter.
