Legal Question in Credit and Debt Law in Texas

Check Written for Wrong Amount

A customer recently wrote a check to my business for a used vehicle and when writing the amount on the ''legal line'' (the long-hand amount), it was written for less than the actual amount of the vehicle. In this case, the difference is exactly $500.00. The customer did this in error, but is now refusing to pay the difference, saying our finance department should have realized this at the time of purchase and the customer's bank cleared the check for the amount written on the ''legal line.'' Is there anything I can do to collect this money? I do have an itemized statement of the customer's purchase with the actual purchase price, which was signed by the customer.

Re: Check Written for Wrong Amount

Go to JP small claims court for claims under $10,000 and if you have an attorney he should get attorney fees plus court costs...without Court order I doubt if you can do anything...
