Legal Question in Credit and Debt Law in Texas

old debt

if there was a debt incurred in a previous marriage the debt being about 10 years old. i dont know how we even got the debt. when they contact me they have the wrong name but the right information. now they have contacted me wanting payment. do i have any responsibility. should i contact them by phone or mail and what should i tell them. thanks bart

Write to them, certified mail, stating that you dispute the debt, and even if the debt was valid, it is barred by limitations. Tell them all further communications are to be in writing.

That should take care of that agency.

If there has been zero activity on the account, for more than four years, in Texas, then the Statute of Limitations has passed, and the debt is uneforceable against you.

HOWEVER, if there is a court order requiring you to pay the debt, then that order can be enforced.
