Legal Question in Credit and Debt Law in Texas

Defaulted Credit Card

My wife is being served papers today for a credit card debt, last payment was made 2/2004. Reading through the other questions it appears to me the credit recovery company that is filing suit is coming in just under the wire of the SOL. What if anything should we be doing, other than hiring a lawyer of course.

file your own answer...allege statute of limitations ..also not true and correct...swear to answer.....and ask them to give you proof of all documents showeing what is owed, etc.....

If you hire a lawyer, that's all you need to do. If its a debt recovery company, be optimistic; you have a good chance of prevailing if you hire a consumer attorney with experience handling these cases.
