Legal Question in Credit and Debt Law in Texas

Hi...I live in Texas and signed a contract to purchase a pre-construction condo in chicago...after having to do a shortsale on my primary house, I could not qualify for the loan on the condo. They now have a debt collector after me for the promissary note on the condo.

I think they cannot garnish my wages in TX for that, correct? also, if they seize my checking account, is it a one-time seizure, or can they keep seizing my accounts, over the years, until all the money is collected?

I would start by questioning the transaction itself to see if everything is on the up and up. I would also have to ask you why you think they are trying to collect on a loan for which you could not qualify. This doesn't make a lot of sense at this point, so I must assume that I am missing some pertinent information.

Wages are not garnishable under Texas law. However, you should know that when a collector sends a demand for wage garnishment to an employer, the employer may pay it nonetheless instead of getting involved in any dispute. This happens much more than you may think.

If your checking account is siezed, first, it won't be just your checking account. It will be ALL your accounts and any other sources of income that they can find and sieze. This area of the law is of particular interest to me, as I have been working a case through the system for the past two years now. And, YES, your account(s) can be siezed for as many times as it takes to pay off what you owe.

If you are considering hiring an attorney to help you with this matter, please give me your consideration. I really have a biding dislike for the way people are commonly victimized in this area of the law.
