Legal Question in Credit and Debt Law in Texas

I had an office call me about a payday loan that I obtain and failed to pay it back in time. I am in the process of making payments and they are saying that they want to take legal actions. If I am paying the agreement can they do this? What should i do?

Generally, if you're one day behind on a loan payment, you can be sued (the creditor can "call" the loan, that is, accelerate it, and demand payment in full).

But you shouldn't put up with being threatened on the phone. Next time they start talking like this, tell them, "Look, I'm talking to you like a man; you talk to ME like a man. Next time you talk about court action, I'm hanging up, and you'll never get paid. This is your last and only warning." And then if they keep talking tough, hang up, and don't ever talk to them again (remember that you have absolute control over whether you talk to someone on the phone; just HANG UP).
