Legal Question in Credit and Debt Law in Texas

Personal Property Lein

I had a lawnmower financed through a bank in Kansas and I live in Texas, the mower was destroyed in a fire and the loan is in default due to non payment as a result of a injury I had, I take full responsibility for the loan and intend on paying but right now I am having financial difficulty. I was just served to appear in court regarding this issue and will lose in court due to my default on the loan. I need to find out if the creditor can place a lien against any of my property. I currently own my home which I live in and another home that is up for sale for profit. Can the creditor upon wining the judgment against me place a lien against either of my properties ? Also the property that is for sale is only in my wife's name, thank you for your help in advance.

Re: Personal Property Lein

The judgment may be against both you and your spouse, and then they can place a judgment lien against your wife's property.
