Reclaiming property

At school start I attempted to sell, in good faith, a clarinet to a student for $300. The mother has only paid $40 since the beginning of school, I agreed to give her until May.But, the family moved to a nearby town and I tried to contact them, they did not return the calls. They are now back at our school and I called the mother at home and told her I either needed money or the horn, she yelled at me for calling their home and said I should not have gotten their number. The horn is at our school, in the band hall, would it be considered theft on my part if I take it? I want to be legal. I do not think they have any intention of paying. What do I do?
