Legal Question in Credit and Debt Law in Texas

my son is receiving calls from a collection agency that states they are a law firm based out of houston, he got a payday loan back in 2009, and now they are saying he is going to jail for a class c felony, since he has not paid it back, i called and tried to make arrangements with them to pay but they were very rude. he does owe the debt and he needs to pay, but really jail??? is that legal

no...record the call as it it a violation of fair debt collections...
