Legal Question in Criminal Law in Texas
arrested
during a traffic stop in texas my brother and wife were searched cause rental car had ms plates and she as driver had md license cop said looked suspicious found crack cocaine and pipe in car. wife said it was hers yet both were arrested and charged. was the search legal? and can they both be charged if one took the blame? what are their options he has a long record with 2 prison terms and is currently on parole and she is clean

"What are their options?" Are you serious? Of course they can both be charged -- a cop doesn't have to take a defendant's word as to the owner of the drugs. Especially when the other person is on parole. They both need attorneys immediately -- or their only option is a long prison term.
