Legal Question in Criminal Law in Texas

class b misdemeanor

My son was arrested last night for possession of less than 2 ounces of marijuana. It was not his car. It was his girlfriends car. He confessed to it so that his gf would not be incarcerated. Can a urinalysis prove that it was not his?

Yes, I would have him do a blood test and a hair carbon test immediately. But, I would also hire a good criminal defense attorney, in your area. The last thing he wants to do his represent himself and even with the hair carbon test and blood test, he will still need an attorney to represent him. BTW: punishment in this case, if any, can effect his drivers license or the privilege to acquire one, as well as any potential student loans from the federal government for college. And no mom, you cannot respresent him and do not turn over the results of these tests to the prosecutor thinking they will dismiss the case. You should talk to and hire an attorney. Good Luck.
