Legal Question in Criminal Law in Texas

My husband is bipolar and our 7 yearold(ADHD)son says his dad hit himbut what he did was stuck his leg out to stop him from running . Well my husband went to jail because he had been drinking that night.Tomorrow I have been subpoena to the grand jury to testify . Is there a law where a spouse can plead the 5th and not have to testify. they wanted my son there to but he is on vacation out of state. So I called the attorney general and told him the the son is on vacation so he said that was fine. should i have our attorney with me tomorrow? Thanks

Speak with your attonry about this. She/He can go to the Grand Jury with you but must wait outside. Always keep in mind, if you have ANY question, you can ask to step outside to speak with your attorney.
