How long can a person be held in jail without an indictment? Our attorney told me 90 days and told my husband 60 days? Which of these answers, if either, is correct?

The State has 90 days to file an indictment before someone in custody is entitled to any relief. After 90 days the Judge should lower the bond to something the defendant can afford or release the defendant on a PR bond. This is not automatic, so your lawyer will have to make it happen. If a court or cause number has not been assigned yet, your lawyer will have to file a writ to get anything done. If there is a judge and cause number, often a conversation with the judge will suffice.
