Questionable possession of marijuana

On aug.29,2005 my younger brother was outside of his apartment smoking a joint. The maintenance man for the complex saw him and followed him back to the apartment. He took the joint from my brother and lectured him about how it could afected his lease if caught with drugs again. He left and nothing else was said. Hours later two police men came to his room and simply asked him if he knew what they were there for. He replied yes and no specifics about exactly why were discussed. They asked to search his home and his truck which he did agree to but nothing was found. A week later an officer came to his door stating a warrant for his arrest had been issued for possession and my brother was taken in. Now he never admitted to having any drugs nor handing the joint over to the maintenance man. His merranda rights were never read to him nor did he even know that he had been charged. He was not questioned only finger printed and locked up. My father made his bail and by noon he was out. If nothing was found on him and the only thing they have is a partialy smoked joint which was given to them by some one else who says it belongs to him legaly what can happen?

Did they question him at any time? Any questions regarding this? Do any of his papers say what his charge is? When does he have to appear in court? Is this his first offense?
