Legal Question in Criminal Law in Texas

Severity of soliciting prostitution without getting caught in the act

A friend of mine hired a prostitute on several occasions and recently his wife found out about it. She is extremely upset and wants to report it to the police to have him arrested. She has a few possibly incriminating emails and text messages. How likely is it that he will get prosecuted for this if he was not caught in the act.

a lot of this will depend on evidence. How did the wife find out? Did the husband tell her? Has he made any statements to anyone that could be held against him in court?

How incriminating are these emails and texts? Getting caught in the act is not necessary to be charged with prostitution. I cannot tell you what the odds are of your friend getting prosecuted, because there are just too many variables. I can tell you that he should be concerned and he should not be sending incriminating emails and should not be assisting in the production of evidence that can be used against him.
