Without doing any research, I would believe "adultry" is defined as having sex with someone who you aren't married to. We'll all have to ask Bill Clinton what "sex" means, I guess.

Adultry would be proven just like any other issue in Court - either by direct or circumstantial evidence. Which could mean pictures, statements, witnesses, etc. Any party that makes a statement to anyone else risks that the statement will be used against them - no warning like criminal cases.

If you want someone arrested for commiting adultery, I doubt the police will cooperate. Otherwise, the prisons and jails would be full!

If you want a divorce based on adultery, it is one of the possible grounds for divorce in Texas. However, Texas now has "no -fault" divorce since it is often difficult to prove a person has committed adultery.
