Legal Question in Family Law in Texas

My aunt is holding mine and my brothers vital documents such as birth certificates and passports against our will, we are now living with our father but she refuses to return these documents. Is there any legal action we could take to get these back?

Try calling the police and report the theft of your documents. Maybe they will help you.

Otherwise, the cheapest way out is to (a) ask the Texas Bureau of Vital Statistics for a replacement birth certificate; and (b) tell the U.S. Department of State that you've lost your passport and need a replacement. It will cost you some fees, but it will cost a lot LESS than suing your aunt.
