Legal Question in Family Law in Texas

if the biological father will not voluntarily sign over his rights and now since has been asked to do so says he wants to see my son but hasn't seen him since my son was a little over a year old and he is now going to be 5 in august. the man im with has been his dad since my son was a year and half old, my son only knows him as daddy and I don't want the father in the scenario messing that up. the father lives with his parents cant hold a job doesn't pay child support but here with me and his daddy he is very well taken care of.....what would be the best thing for me to do?
