Legal Question in Family Law in Texas

I want to change my son's last name to his real father who i have lost all contact with. My son is currently wearing this last name of the person that i thought was his father but we took a paternity test that proved that he wasnt. No one signed his birth certificate but to change his name i have to go through the courts. On the name change documents it asked for petitioner and co-petitioner signature that needs to be notarized. The only choices is has for the co-petitioner not to sign is if that person is dead or has signer over there rights. So being that i cant get in contact with him what am i suppose to do about the co-petitioner portion. And should i proceed in getting my son's last name changed.

You need to hire an experienced family law attorney to assist you.

If you are trying to do this yourself, I doubt that you are going to be successful.

You need to find the man that you think if the bio. father & have him served. You might not be able to find him, but I suspect that when the judge appoints an attorney to represent the "unknown father" that attorney will find him.
