child custody

my mother-in-law has custody of my wife's daughter while my wife is on probation. there is nothing that says she cant have custody of her but cps doesn't want to reunite them. how do we go about getting custody because her mom is willing to sign over custody?

You might have to do battle with CPS. If she is CERTAIN that there are no court orders restricting her possession of her daughter, then she needs to go pick her up. If there is a court order which restricts possession or conservatorship, then she needs to file a petition to modify that order. In either event, CPS will respond, and she needs to be prepared appropriately. She will need a lawyer.
