Child Custody
Situation: Mother and father of 3 year child that are unmarried, but have cohabitated for 5 years in Texas can not agree on joint custody. Mother has been employed most of relationship with few short gaps of unemployment. Mother was charged with medical neglect and voluntarily relinquished rights to first child in 1998. Mother has given 2 children in 2002/2004 for adoption. Father has been unemployed for most of relationship. Both are good parents, though mother is slightly more involved (all doctor visits, general care for child, etc.) . Which parent is more likely to be awarded custody of child? Should mother's past pose problem? Mother was approved in appeal to work at a liscensed child care by CPS in 2007.

Your description describes most parents: a few flaws and many good points. Barring evidence that one of the parents poses a danger to the welfare of the child, most courts are going to appoint the parents joint managing conservators, with one parent named as primary and the other with expanded possession. If you cannot agree, you could try a mediation session, prior to embarking on a contested hearing.
