Legal Question in Family Law in Texas

child support/visitation

i am in court now for child custody issue. cps gave me my son after his mother failed 2 drug tests. his mother called cps on me and i failed 2 as well. went to court and discovered mother has drug case against her along with not having a job, lying about past employment etc i nthe court before the judge. because i failed my test the judge is still making me pay child support and gave us joint custody 1 week apiece until the final court hearing, and i have to go to cps family plan services. is this how its done? i have had a job for 7 years, never missing a child support payment for out 3 yr old, but it seems the judge was much harder on me, i assume for failing my test--this was a temporary hearing.

Did you both have a lawyer? Honestly, I am surprised you both came out as well as you did. It would not have been unusual for the judge to give conservatorship to CPS, with instructions to find a family member, with supervised visitation.

Here's some advice you're not going to want to hear: You are going to have to choose between taking drugs and having a son. If you keep it up, CPS will terminate your parental rights.
