Concerned Mother

My daughters father has not seen or called in a year, and is behind on child support ($12,000.00). Is there any way, if he agrees to sign, the father give up all parental rights, of our daughter; and if he doesn't can I still change her last name, we do have divorce papers, but he is not on her birth certificate? Please help.

I assume you divorced in Harris County, Texas. The Judges in Harris County usually will not terminte a parent's rights unless there is a new "daddy" in the wings.

You cannot change her last name while she is a minor without her father's consent.

Regarding the past-due child support, you need to file contempt on him.
