Legal Question in Family Law in Texas

My divorce and custody agreement took place in Texas, my ex moved to Louisiana and is now threatening to take our son away if I do not come back to him. Can he file in Louisiana or does he have to file in Texas, we(child and I) still live in Texas. Everyday I get texts and phone messages if I do not talk to him that he is gonna go through with this.

The court that granted the divorce still has jurisdiction over the child. You need to talk to a family law attorney and have the person review your document.

If you still live in Texas and in the same county where the divorce was granted then he should not be able to move the case.

But you cannot stop him from trying so you need to find a Texas attorney and a Louisiana attorney in case you need one in the future. Look on this website and on www.avvo.com for an attorney.

Good luck!
