Legal Question in Family Law in Texas

my ex-husband is trying to pick up our kids for his weekend (which this is the first time since the divorce 3/14/11), he doesnt have a stable living environment. I am scared that he will take them and not return them, since he has someone woman from another city taking care of him. He has no job, no place to live, no money, and a warrent and he hasnt been paying child support. I want to know what is my legal rights to protect my children.

If you have an order that says that he is entitled to possession, then you must follow the order or be subject to contempt of court and incarceration.

You can file an emergency motion to modify the order. Were these facts the same in March when you got the order? If so, then the court should have taken them into account and may have decided to do this order anyway. You will have a hard time changing the order if the facts have not changed.
