Legal Question in Family Law in Texas

My fiancee had a common law marriage in Texas and bought a house together (10 yrs ago). Her ex still hasn't refinance the house into his name just his name. Is there something we can do to make him refinance into his name or into our names?

No, you can't force someone to refinance a house. How could you force a bank to extend credit to someone? Some people can't get a home loan anywyere because of bad credit.

Issues of refinance are usually unenforceable. If there was a divorce decree, it may be possible to force a sale of the house. It depends upon the actual legal status of the house.
