Legal Question in Family Law in Texas

Insurance

What happens when my husband's company doesn't offer insurance? Does his ex-wife have to provide it for the children? She has primary custody and she is complaining saying he has to provide it and if he doesn't that it is against the law. Is all of this true?

Re: Insurance

That depends entirely on the divorce decree entered by the Court. Generally, under Texas law, the spouse ordered to pay child support (the obligor) is also ordered to provide medical insurance. The decree will usually specify that if the obligor does not have insurance available through his employer, he must provide private insurance. However, the answer to your question will be determined by the actual decree. That information can usually be found in a section entitled "Medical Support."

If your husband would like to schedule a consultation to have an attorney look over the decree to answer your question, I would be happy to schedule that. Good luck.
