Joint Custody and Child Support

If the Father of my son and I share joint legal custody of our son, does he have to pay child support?

Your question implies that there is no order for payment of child support at this time.

The parties can agree or the judge will make a decision concerning which parent should have the authority to establish the child's primary place of residence. The other party will be required by court order to contribute to the child's expenses by paying child support. The support figure will be based primarily upon the paying party's income level.

Custody (legal rights and duties), possession and access (visitation), and child support obligations are all separate issues. Joint custody has nothing to do with child support. Just because the two of you share equal or nearly equal rights and duties as relates to the child does not mean one of you won't have the duty to pay child support. Even near equal amounts of time with the child does not mean one of you won't have to pay child support.
