Legal Question in Family Law in Texas

My in laws have temporary custody of my three kids. We are waiting on the results of a drug test to determine what happens next. They said I had exposed my kids to family violence . Can I have my kids back after the drug test comes back negative with out any further involvement with child protective services. At the time my in laws have been given strict rules that they are to have no contact with their dad or his brother. And she has not been following these instructions. she allows them to be around the kids . Is there anything I can do ?

If CPS is involved then they will probably not want the temporary custody to end.

From your question it appears that you exposed the children to family violence. If this is what CPS is alleging, then passing the drug test won't mean that the children will be returned to you. You should anticipate receiving a list of things you need to do in order to regain custody of your children.

I would immediately hire an attorney to help you. Check out this website & www.avvo.com for an attorney that handles CPS cases. There aren't that many out there since CPS is so difficult to work with.

Good luck!
