Legal Guardianship Rights

My sister obtained ''power of attorney'' from my father without my mother's knowledge. My mother had to get ''legal guardianship'' of my father to revoke the power of attorney since my father is not able to make decisions for himself. During the time that my sister had power of attorney, my father received an inheritance in the form of money which was given to her. Does she have the legal right to keep his inheritance or does she need to turn it over to my mother which is now the legal guardian?

I sounds like your father may not have had legal capacity to execute a power of attorney when your sister obtained it. Your mother's permission was not necessary. If this inheritance is still available and you want to pursue recovery, call me at 956-994-1127.
