Usually, a Motion for Non-Suit is a motion brought by the person who brought the lawsuit to dismiss their side of the case (or close their causes of action or claims).

However, if a counter petition, or counter action was brought by the opposing party after the original petition was filed and properly served, only one side of the lawsuit can be dismissed. The only way the other case can be non-suited after this occurs, is by both parties' joining in the non-suit.
