Legal Question in Family Law in Texas

obtaining spousal and dependent benefits

I am currently married to someone on active duty in the U.S. Army. We have been separated since 1999. Our separation is not court ordered. We have a 7 year old son together. I was told through the Department of Defense, that I need to obtain a court order in order to receive any type of benefits. Is this correct? What necessary steps do I need to take in order to get this process started?

Consult with an attorney. There are excellent Houston family law attorneys on this website.

He has some specific protections under the Sailor and Soldier's Relief Act, however he is still obligated to support his child. A family law attorney will be able to obtain results for you.
