If parents are divorced and the mother is the primary care giver, can the father get the child out of spite/

Spite is usually not a good reason to mix up the parenting relationship. Spite might motivate the father to present evidence of a legitimate reason but at that point the spite is irrelevant. If you believe you are about to get into a custody battle then you need to hire counsel now.
