Legal Question in Family Law in Texas

Pregnancy and divorce

I have been seperated from my husband for a year and turned in papers for a divorce three months ago. I am now pregnant with someone elses baby. Will they still go through with the divorce? I have not had any contact with my spouse, he has only supervised visitation with the local kids exchange. I have a protective order on him for me and the children. I am using the legal services here because i cannot afford to pay the 2500 for a lawyer. What do i do?

Re: Pregnancy and divorce

You need to talk to legal services.

Usually the courts will not grant a divorce if you are pregnant. You will need to wait until after the baby is born. At the hospital the father of the baby needs to sign the necessary paperwork in front of the appropriate person (each hospital has the forms and a person qualified to approve the paperwork) so declare his paternity of this child.

Best of luck to you.
